As a person who investigates these incidents, you cannot assume it’s due to the automobile driver being a “moron”. What did the police report say? There are a lot of variables that maybe show the driver is not a moron at all. Was the crossing working properly? Just because the lights are flashing doesn’t mean it was working PROPERLY. How long were the lights working before the train giotto the crossing? Do you have a download from the crossing ? Was the automobile working properly? Maybe the brakes failed. How about the impairment of the driver? Medical condition? See, you can’t assume “moron” I have to read the report. One thing is certain though... you can’t blame a cell phone for being a distraction. Those things were quite rare then.

Also as a PERSON who has investigated close to a hundred of these accidents over 30 years in LE - I'm inclined to believe Craig - the guy WAS a moron, perhaps adjusting his cassette or 8-track.....
